Terms & conditions
- All Quotations/Estimates are based on approximate volumes and estimated costs current at the time the quotation is produced, these costs will be confirmed on acceptance of the order.
- Prices are valid for 30 days from date of quotation. All prices are held for 3 months from Date of Acceptance. Any additional tasks requested but not quoted are chargeable.
- Prices are exclusive of VAT, Transport, Materials, Samples and Postage unless otherwise stated.
- All Postage costs are purely estimates and final total postage costs will be confirmed on receipt of the final Royal Mail invoice. Any variation will be invoiced or credited to the Client at that time.
- When mailings are required to be mailed on MacDonald Mailing Postage Account, a pro-forma postage invoice for the full amount will be raised. No posting of mail will take place until MacDonald Mailing receives cleared funds for the full postage costs. Any postage discount will be credited back or refunded to the client when the final invoices have been received by MacDonald Mailing from Royal Mail.
- Delays in scheduled delivery of your materials/data to MacDonald Mailing could result in chargeable downtime being incurred. Chargeable overtime work may be required to still achieve your posting date, or your posting date may be delayed.
- Re-scheduling of work is subject to the capacity available.
- All Client materials should be delivered in boxes on pallets or securely shrink wrapped pallets. Each box/pallet should be clearly labelled and give details of the campaign name, content type and quantity. Each delivery should be accompanied by a delivery note, which details the total delivery.
- Due to the volume of deliveries received, MacDonald Mailing will only count the number of boxes and pallets delivered and will accept and sign for clients materials “unchecked” and will accept no responsibility whatsoever for any apparent delivery shortfall. If you require an accurate count of your materials delivered to us, this can be arranged at an additional cost.
- Most of our production possesses are mechanised and produce a small number “spoils” during set-up and running. To ensure that we have sufficient materials to complete the job we strongly suggest, that when you supply materials to MacDonald Mailing you supply at least 3% more that the total required to for the job, to allow for material used for set-up and “spoils”.
- When MacDonald Mailing is asked to supply materials we will automatically produce at least 3% of “overs” and the costs of producing those “overs” will be charged on to the Client.
- In the case where insufficient material is supplied by the Client to complete the order in one process a surcharge equal to the labour cost incurred by MacDonald Mailing for stopping and restarting the process may be made.
- Clients data is accepted subject to the compatibility of the database, data is disposed of after use as per the guidelines laid down in the Data Protection Act unless data storage arrangements have been made, such arrangements are usually chargeable.
- All stationery supplied to MacDonald Mailing by the Client for laser personalisation should be of “laser guaranteed” quality. MacDonald Mailing will not accept any responsibility for any stationery supplied by the Client that will not run through our laser printers. If you are unsure of your materials suitability to run through the laser printer please supply printed test stock (minimum 500 sheets) in advance for testing.
- All enclosing prices are based on machine enclosing unless specified. Machine prices are based on materials being of machineable quality. If for any reason components do not meet machine specifications, MacDonald Mailing reserves the right to alter their prices.
- Storage of goods and materials will be charged at £1.00 per pallet per day. Storage charges will be incurred for materials stored for more than 14 days. This is in addition to any storage charges detailed or included in the contract.
- Invoices will be submitted monthly, or at the conclusion of the work at the discretion of the MacDonald Mailing. Our payment terms are strictly 30 days from the date of the invoice. Queries on invoices must be raised in writing within 14 days of their receipt otherwise they can not be entertained. New Customers may be asked to prepay the costs before the work commences.
- Any goods belonging to the Client which are on the company's premises are held by MacDonald Mailing at the Client's own risk in all aspects, with the unlikely exception of internal pilferage.
- Where work is found to be defective for any reason including negligence or late posting or delivery, our liability (if any) shall be limited to a maximium of the value of the job or specific part of the contract in dispute. MacDonald Mailing Limited shall not be liable for any consequential loss under any circumstances, whether the claim arises in respect of delay, defective work or howsoever.
- Any alterations to any artwork, supply of proofs etc. requested by the Client will be charged in addition to the original quotation.
- Every effort will be made to carry out the contract, but it's due performance is subject to cancellation by us or to such variation as we find necessary as a result of inability to secure labour, materials or supplies as a result of any act of God, war, strike, lockout or other labour disputes, fire, flood, drought, legislation or other cause beyond our control.
- These conditions and all other terms of the contract shall be governed and construed in accordance with the Laws of England and the customer hereby irrevocably submits to the exclusive jurisdiction of the English Courts.
